NOTICE OF HEARING ON AMENDMENT OF CONSTRUCTION PERMIT On November 30, 1979, the Nuclear Regulatory Ccemission published in the Federal Register a Notice of Opportunity for Hearing on a Proposed Issuance of an Amendment to Construct: ion Per-mit CPPR-104 that had been issued to the Northern Indiana Public Service Company (Per=ittee) for construction of the Bailly Generating Station, Nuclear 1 (the facility), a boiling water reactor to be located 12 miles northeast of Gary, Indiana.

The proposed amendment would extend the latest date for completion of the facility from September 1, 1979 to December 1, 1987.

l The Notice indicated that the Commission must make the findings required by the Atomic Energy Act of 1954, as amended, and the Coc=iasion's Rules and Regulations, including 10 C.F.R.

S 50.55 (b),

which requires a showing of good cause for the extension of the ccm-pletion date for a reasonable period of time.

2-that Per=ittee's application for extension had been filed core than thirty (30) days prior to the date for expiration of the per=it, as required by the Ad=inistrative Procedure Act and 10 C.F.R. 5 2.109, and that, consequently, the construction permit would not be deemed to have expired until the application has been finally determined.

The Notice also provided that, by Decenber 31, 1979, the Permittee and any person whose interests may be affected by the pro-ceeding might file a request for a hearing with respect to whether, pursuant to 10 C.F.R. 5 50.55(b), good cause has been shown for the requested extensica, i,.e., whether the causes put forward by Permit-tee are among those which the Co= mission will recognire as bases for extending the completion date.

By that date, individual petitions were received from: George Schultz, Local 1010 of the United Steel-workers of America, the Lake Michigan Federation, and the State of Illinois.

Joint petitions were also received by that date from a group of petitioners denominated " Porter County Chapter Petitioners",

another group denominated " Gary Petitioners", and George and Anna Grabowski.

An Atenic Safety and Licensing Board was designated to rule upon intervention petitions and request for hearings, and to preside oier the proceeding in the event that a hearing is ordered, The ce=hers of the Board are: Mr. Glenn O. 3right, Dr. Richard F.

Cole, and Mr. Herbert Gross =an who will serve as Chairman of the Board.

3-On August 7, 1980, the Board granted the petitions of Local 1010 (conditionally), the State of Illinois, Porter County Chapter Petitioners, and George and Anna Grabowski.

As a result, a hearing to consider the proposed amendment to construction per-mit will be held near the site of the Bailly construction, a.t a time and place to be established.

LLaited appearance statements will be heard at the hearing.

Members of the public may request permission to make a limited appearance pursuant to 5 2.715(a) of the Commission's Rules of Prac-tice, 10 C.F.R. Part Two.

Persons desiring to make limited appear-ances are requested to inform the Secretary of the Co= mission, U.S.

Nuclear Regulatory Commission, Washington, D. C. 20555.

A person making a limited appearance does not become a party but may state his position and raise questions which, if relevant, the Board may require be answered by the parties through evidence on the record.

Limited appearances will be received at the time of the evidentiary hearing within such limits and on such conditions as may be fixed by the Board.
