Shutdown Capability Analysis

Dear Sir:

g During the eighteen months that have elapsed since our submittal of the summary of our analysis of the capability to safely shutdown in the event of a fire [Refererce (b) above], criteria for that safe shutdown have been developed and promulgated. It appears that the staff reviewer has used many of these new criteria in his evaluation, then has taken Vermont Yankee to task for not responding to these criteria. We wish to point out that our response was to a requirement that the licensee " provide a summary of an analysis which demonstrates that safe shutdown systems can be placed in operation independent of fire damage to electrical circuits in either the control room, cable spreading area, or switchgear room."

At the time that our submittal was made, there existed no criteria other than our own, which were clearly stated in the submittal, and our analysis dealt with those criteria.

Ippolito, Chief Page 2 It will take far longer than the -thirty days allowed in your letter for us to respond with an analysis which takes into account the new criteria for safe shutdown. As the new criteria have become a part of the proposed Appendix R to 10CFR50, we propose that we submit the analysis by whatever date is established when the rule is published in its final form.
