Dear Sir:
We have enclosed payment of the civil monetary penalty as ordered in the above referenced letter (Ref. a.).
Your consideration of our arguments and your mitigation of the originally proposed penalty is accepted as an equi table resolution.
Our original statement of corrective actions (Ref, b.) regarding the future arrangements for exclusive use of transport vehicles did not include the specific instructions which we have been providing to the carrier on our shipping papers since 12/79.
These have been as follows:
" SOLE USE VEHICLE NOTE: This shipment of radioactive material may not be trans-ferred to a transport vehicle owned by another carrier.
Also, the individual containers may not be shif ted on this vehicle so as to exceed:
(a) 200 mrem /hr. on the vehicle surface (b) 10 mrem /hr. six feet f rom the vehicle (c) 2 mrem /hr. in occupied areas of the vehicle."

, Inspection & Enforccment July 29, 1980 s-We will change the above statement on all future shipments that require exclusive use of the vehicle to reflect the guidance in your letter of 7/11.
These instructions will be revised to read as follows:
" SOLE USE VEHICLE NOTE:
This shipment of radioactive material may not be trans-ferred to another transport vehicle, and the individual containers may not be shif ted on this vehicle, and the relative posi tions of the fif th wheel and the occupied areas of the tractor may not be changed unless the below listed radiation dose rates are not exceeded as tne re-sult of any change.

We believe this and prior corrective actions will prevent future similar incidents.
