NOTICE OF INTENT TO FILE Consumers Power Company (Licensee) hereby notices its intent to file a petition for reconsideration of portions of the Board's September 23, 1977 Order denying, inter alia, motions for suspension of construction permits for the Midland Plant. The petition will be filed in accordance with 10 C.F.R. S2.771, within ten (10) days after the date -

of the Board's decision. Licensee also hereby notices that l

it does not intend to file the exceptions permitted by paragraph (2) of the Order and 10 C.F.R. 52.762.
