Dear Mr. Chairman:

I enclose a Motion of the Saginaw Valley Intervenors which has today been served upon all of the parties.

Later this week we will subr.it our views with respect to the course of these hearings.

We would urge the Board not to issue any orders of any kind (other than the granting of the enclosed Motion) until such time as it has received a definitive statement from all of the parties as to how to proceed, particularly word from the Regulatory Staff and/cr Atomic Energy Cor.r.ission.

Sin:e the Court of Appeals has in effect struck down regulations both procedural and substantive dealing with environ-mental issues, there is serious question as to whether if the Board does anything now, it will be engaging in invalid rule making proceedings.
