PETITION FOR WITHDRAWAL OF THE PETITION TO INTERVENE As the result of several recent developments,.a'nh a' general reevaluation of the Environmental Defense Fund's legal commitments it'has been determined that'EDF should withdraw as an intervenor in this proceeding.

This position is based primarily upon the fact that two other intervenors -- Saginaw and Map'leton -- are ably represented and concerned in part -ith the same issues as EDF.

The significance of the issues raiscc.

7 EDF persists and its withdrawal is neither intended to be a waiver of those issues in the proceeding with respect to other parties nor an indication that the issues should not be decided favorably to the position

-taken by EDF.

This action does present difficult problems for other parties who were relying upon EDF to take the lead with respect to the legal issues raised by it.

We would hope that the Board would be

sensitive to this problem and would entertain any reasonable requesQ by the parties for an' extension of the April 24th deadline for filing of a brief on those legal issues.

The recent schedule request of Saginaw would be consistent with this relief and we trust the Board will grant it.
