AEC REGULATORY STAFF'S MOTION FOR AN EXTENSION OF TIME TO FILE REPORT, COMMENTS AND OTHER INFORMATION REQUIRED BY ALAB-132

On June 28, 1973, the Atomic Safety aAd Licensing Appeal Board issued in

..this proceeding a Memorandum and Order (ALAB-132) which directed the AEC Regulatory Staff either (a) to file within 10' days of the date of ALAB-132 a report of any full-field inspection of the Midland Plant conducted subsequent to March 26, 1973, or, in the event no full-field inspection had been conducted since March 26, (b) to conduct such an inspection within 30 days of the date of ALAB-132 and to report to the Appeal Board within 10 days after completing the inspection. The Appeal Board also directed the staff to include in the fore-going report all of the information called for by Condition 2 of ALAB-106, as of the date of the report, and to provide with the report staff comments on the applicant's previously filed report to the Appeal Board pursuant to Condition 1 of ALAB-106.

, A full-field inspection of the Midland Plant was conducted by the staff on June 26-28,1973. Pursuant to ALAB-132 the staff is required to submit its report on the inspection within 10 days of June 28, 1973, the date of ALAB-132. However, since the tenth day, July 8,'is a Sunday, the report is actually due on Monday, July 9,1973.
As a result of our evaluation of the effort required of the staff to meet the requirements of ALAB-132 and the staff rekources available for that effort, we are requesting an additional nine working days to comply with the directives of ALA3-132. In support of this request, we note that, in the ordinary course of business, the preparation and issuance of an inspection report typically spans a period of about three weeks, and that the effort here required clearly involves more than the preparation of an inspection report. Furthermore,
the short period now available for preparation of the staff's report and comments is divided by a national holiday, July 4th.
The Appeal Board should also be aware that resumptMn of full-scale construction at the 'didland site has not occurred. The work force at the site comprises approximately fifty individuals who are engaged in a variety of activities -- such as, for example, removing concrete forms, requalifying materials, and reconstituting the concrete batch plant -- the general purpose of which is simply to prepare the site for the resumption of full-scale construction.
_ 3 For the foregoing reasons, the AEC Regulatory Staff moves the Atomic Safety and Licensing Appeal Noard for an order extending by nine working days (i.e., until July 20,1973) the latest date for the submission of the report, comments and other information required of the staff by ALAB-132.
