RESPONSE OF NRC STAFF TO INTERVENORS' MOTION FOR SANCTIONS AGAINST CONSUMERS POWER COMPANY p @ 77 On December 31, 1976, the Intervenors other than Dow Chemical Company (Intervenors) filed a motion to impose sanctions on the Consumers Powrr Company and a memorandum in support of their motion for sanctions. The motion requests the Atomic Safety and Licensing Board (Board) to impose sanctions on the Consumers Power Company in response to Consumers' actions in the preparation and presentation of Mr. Temple's testimony.
This Board had previously requested that briefs be submitted on the issues related to the preparation and presentation of the testimony of Mr. Temple.
(Tr. 502-516).
One of the five questions which the Board had asked to be briefed was:
Would sanctions be appropriate in these circumstances?
If so, what form should they take?
(Tr.516).
The Nuclear Regulatory Commission Staff (Staff) on December 30,1976 filed a memorandum with the Board in response to its questions and addressed the 80ovase 7WG

Preparation of Testimony of Dow Witness Temple (December 30, 1976).
For the reasons given in that memorandum, the Staff opposes the motion of the Intervenors to imp)se sanctions against the Consumers Power Company.
