Dear Mr. Cherry:

We have your letter of August 21, 1973, regarding our letters of August 2 and 9,1973.

On the basis of an examination of our file copy of our August 2 letter, I have in agree that at least some of the documents we forwarded to you with that tetter were illegible. I propose to remedy this situation in the manner we discussed over the telephone on. Friday, August 24: that is, a courier from the Region III office of the Directorate of Regulatory Operations will bring to your office the original documents so that you can inspect them and, if you wish, duplicate them on your own machine. The courier will also

.' bring a zerox copy which you may retain in' lieu of reproducing the docu-ments yourself.

After you have had an opportunity to inspect and duplicate the originals, the courier will mail them to me so that I may make direct xerox copies for '

transmittal to the Appeal Board and the other parties.

With regard to the matter of the acceptability to you of our response to category 1(c) of your letter of July 3,1973, we remain of the view that the ecope and content of our June 26-28 inspection is made clear in docu-ments already available to you. I wish to emphasize that we are not now involved in discovery. There is no basis under the Commission's rules or any orders cf the Appeal Board for discovery in this proceeding at this time. Particularly in these circumstances, we consider it not unreasonable to respond to category 1(c) by reference to documentations in your possession.
