Dear Hr. Engelhardt:

The AEC Regulatory Staff, April,1973, reports on new and more conservative siting guidelines for nuclear plants which have fin-ally been published, indicate that the IIidland and Fermi #2 sites in Michigan vould not be considered as safe by the new standards for safety.

I have uritten Congressman Cederberg and Senators Hart and Griffin about this and asked them uhat they planned to do about it, since the sites involved millions 'of people in Michigan, f Congressman Cederberg has replied that since the Midland con-l struction licensing is still pending in federal court that these j siting issues will be considered by that legal process.

l Tt is my view and that of our atto:ney8 s, that the siting issues can no longer be considered in the legal channels that are still pending for the Midland site.

L I wonder if ne could have a clarification of the types of issues the legal matters still pending on Midland #1 anc #2 uill address themselves to and if the siting of-these plants will be among those considerations.
