NOTICE AND ORDER FOR PREHEARING CONFERENCE On January 23, 1974, the Atomic Energy Commission (Com-mission) published in the Federal Register (39 Fed. Reg. 2619) a " Notice of Hearing on Order to Show Cause" (Notice of Hearing),

to consider whether the activities under construction permit Nos. 81 and 82, issued to Consumers Power Company for Midland

?lant, Units 1 and 2, should not be suspended pending a demon-stration by the licensee of its compliance with the AEC's quality assurance regulations.

Specifically, the Commission's

" Notice of Hearing" indicated that a hearing would be held before an Atomic Safety and Licensing Board (Board) on the issues framed in the Order to Show Cause issued on December 3, 1973, by the reirector of Regulation to the licensee concerning quality as-surance compliance in the construction of its Midland, Michigan, i

Plant, Units 1 and 2.

These issues to be decided by the Board are:

1.

Whether the licensee is implementing its quality assurance program in compliance with the Commission's regulations; and 2.

Whether there is reasonable assurance that such implementation will continue throughout

the construction process.

Th3 Commic Aon's "Notico of Escring".2rther indicated that should either of the foregoing issues be decided adversely to the licensee, the Board shall determine whether the construc-tion permit shall be modified, suspended or revoked, or whether cther action is warranted by the record.

The " Notice of Hearing" order'ed that the parties to the hearing shall be the regulatory staff, the licensee, the Sierra

. Club petitioners, and the Dow Chemical Company.

In addition, the " Notice of Hearing" provided that any person whose interest may be affected by the proceeding, who wishes to participate as a party to the proceeding, nust file a written petition, under oath or affirmation,'for leave to intervene in accordance '

with the provisions of 10 C.F.R. 5 2.714.

On February 11, 1974, Bechtel Power Corporation and 3ecn-tal Associates Professional Corporation lodged with the Commis-sion a Petition to Intervene.

The " Notice ofikaring" provided that any person who does not wish, or is not qualified te become a party to the proceeding, may request permission to make a limited appearance pursuant to the provisions of 10 C.F.R. 5 2.715.

No requests for permis-sion to make a limited appearance have been received.

Finally, the " Notice of ! baring" stated that the hearing shall be held at a time and place specified by the Board.

Pursuant to the Commission's " Notice of Hearing" and the authorization therein for the Board to set a time and place for he,aring, notice is hereby given that a prehearing conference will be held at 10:00 a.m., on Thursday, March 28, 1974, in
