Dear Mr. Chilk:

As counsel for Myron M.

Cherry in connection with the above-captioned proceedings, we recently were furnished a copy of a letter to you dated April 10, 1978, from Michael I.

Miller, counsel for Consumers Power Company, in which Consumers raises certain objections to the settlement of the special proceeding proposed by the parties.

Not a single one of the documenta listed on Appendices A and B to the settlement agreement and to be withdrawn or stricken in accordance with that agreement was submitted by Consumers.

None of these documents relate to substantive matters and all are completely collateral to the underlying issues before the Midland Loard.

It is apparent that Consumers has raised no ind~'est in the pro-posed settlement and no legitimate objection to its terms.

I have discussed this matter with counsel for the NRC staff and they are in agreement with the views expressed in this letter.
