IHIS DOCUMENT CONTAINS PROIECTIVE OEER P00R QUALITY PAGES In response to an Order of the Board, Consumers Power Company has submitted a nmorandum concerning the circunstances surrounding the preparation of certain testirony. Although the nuorandum is dated Decarber 30, 1976, and bears a postmark of the sane date, it was not received by the Board until January 6, 1977.

Included with the necrandun are the affidavits of Messrs. Mosso, Renfrcw and Bacon and attachments A through P.

Also included in the submission is a Motion for a Protective Order prohibiting any party from disclosing or utilizing the contents of the affidavits and the attactrents.

Because the evidentiary hearing is soon to be resumed, we are issuing this Protective Order as a temporary measure pending a review by the Board to deteranne whether such an order is appropriate. The materials will be distributed ncu under this temporary order so the parties may be aware of their contents. This order may be later redified or revoked, accordingly.

Tne parties have been unable to agree en the scheduling of witnesses for the evidentiary session beginning January 18, 1977.

Because we are reluctant to interfere with the presentation of its case by a party carrying, at least, the burden of going forward with the evidence, our order will follow Licensee's preposal.

The place of hearing for the session beginning January 18, 1977, has been changed to what, we are advised, is larger space.

We will be in Room 1220 on January 18, 1977, and Roon 2'05A for the balance of the week, both in the Everett McKinley Dirkson Building, 219 Scuch Dearbcrn Street, Chicago, Illinois.

The Board is unable to sit during the week of January 24, 1977, and the hearing will be in recess fren January 21, 1977, until January 31, 1977, when it will reconvene at a tine and a rocn to be designated.

Dow has requested that the Dece=ber 14, 1976 transcript be amended to include:

"Mr. Wessel:

I apologize for interrupting, but I must correct Mr. Rosso's statement,

'Dow has said they believe they have a valid contractual co==itment.'

Not to respond to an inaccurate co==ent when one is present, might well constitute an ad=ission by silence in sobe future proceeding in which the nature of the Dow-Consumers contractual obligation is an issue.

"Dow has never taken the position that it has z.

a valid contractual co==ittent with Consumers.

What I said earlier, which has been Dow's position throughout, is that Dow will continue to honor our contractual obligations as we see the=.

There is, of course, a substantial dif-ference between these two positions.

"Mr. Rosso:

I apologire for inadvertently misquoting Mr. Wessel's position."

The Staff agrees with Dow except that it urges the following statement to be added to Mr. Rosso's co==ent:

"Mr. Wessel's correction does not change the import of what I said."

The Staff alleges the omission occurred after page 939 of the transcript and.before page 940.

No party has objected to the Dow request nor that of f

the Staff.

Both omissions therefore should be added to the transcript.
