1. 2. At the same time, in response to the request by intervenor New England Coalition on Nuclear Pollution (NECNP) that the Seabrook con-struction permit should be suspended because further construction would cause NECNP to suffer pr' judice, the Atomic Safety and Licensing Appeal Board, in the Seabrook proceeding, ordered that briefs on legal quest %s substantially similar to those posed in Vermont Yarrkee and Midland be soon4o Sr;3 g

,i filed by September 2,1976. Oral argument was scheduled for September 8, 1976.

3. Also, on August 19, 1976, intervenor i!ECi:P requested that the time for filing briefs in the Ver:nont Yankea proceeding u azt:nded uatil September 17, 1976, because intervenor's cconsel had made " unalterable" vacation plans between then and September 7,1976. NECliP counsel is the same in both the Vermant Yankee and Seabrook procaedings.
4. The !!RC Staff believes that the briefing, oral argu.i:ent, and Appeal Board decision on NECHp's. request for suspension in Seabrook may offer extremely useful guidance to the Licensing Boards and the parties in Vermont Yantee and i!idland. Thus, in the !!RC Staff's view, it vould be desirabis if the briefi6g, argcreat, and decMion in p mt YM:c: cr2 111dland be postponed until after tne Appeal bonrd has had the oppcctu-

.nity to hear and decide similar issues in Scabrock. Uhile it is speculative at this point to assess the relative urgency of the three cases (for example, the weight to be accorded the fact that Vermont Yankee is generating nuclear waste materials, uhile Scabrook and Midland are not), intervenor NECMP's motions in Seabrook and Vermont Yankee are consistent with a view that Seabrook may~ appropriately be decided first.

5. Accordingly, in the interest of. developing a consistent and reasonably i

authoritative body of legal principles on the suspension question, the NRC Staff moves that briefs by all parties in Midland and Vermont Yankee

be filed.by September 17, 1976. This would be consistent with NECNP's 1 motion in Vermont Yankee.
