Special Proceeding POOR QUAUTY PAGES Docket Nos.50-329SP,50-330SP
Dear Ms. Cohen:
Receipt of your letter dated June 8,1978, with enclosure, is acknowledged. The enclosure was a copy of a letter dated January 24, 1978, addressed to individual members of the special board and signed in the name of " Mary Sinclair, Chairman on behalf of the Saginaw Intervenors. "
Though your transmittal letter offered no explanation of why a
you wished the letter be filed, we assume that the letter was trans-mitted for filing in response to paragraph 5 of our order dated May 23, 1978. However, the letter does not satisfy the requirement of para-graph 5 of said Order.
So that the Saginaw intervenors in the special proceeding may be properly identified, the special board is hereby granting to you further time, until June 30, 1978, to satisfy the requirement of para-graph 5 of the Ordec.
In passing, we note the following. In the initial decision in the Matter of Consumers Power Company, Docket Nos. 50-329 and 50-330, 5 A.E. C. 214 (December 14, 1972), it was reported at page 215, paragraph 2, that --
"Against the application, a joint petition to intervene was filed by the Saginaw Valley Nuclear Study Group, Citizens Committee 8007240 $ 6

Further, in the same report of the proceeding, at page 214, Myron M.
Cherry, Esq., was identified as having made an appearance on behalf of each of the above named constituents of the "Saginaw Intervenors",
except Trout Unlimited. That organization was reported as having withdrawn from the proceeding before the hearing on environmental matters, 5 A. E. C. at 215, footnote 4.
Later, in the opinion of the Supreme Court of the United States in Consumers Power Comoany v. Nelson Aeschliman, et al.,
No.76-528, which was heard and decided by the Supreme Court together with Vermont Yankee Nuclear Power Cornoration v.
Natural Resources Defense Council, Inc et al., No.76-418, April 3,1978, the Supreme Court identified the Saginaw intervenors, which were respondents, in the following matter:
~~
"Saginaw included the Saginaw Valley Nuclear Study Group, the Citizens Committee for Environmental Protection of Michigan, the United Auto Workers International, and three other environmental groups. " Slip op., page 9, footnote 9.
The record of Consumers Power Comoan_v v. Nelson Aeschliman, et al. in the Supreme Court shows that the respondents were repre-sented by Myron M. Cherry, Esq.
Under the authority provided for at $2.718 of the Commission!s Rules of Practice, the special board seeks to ascertain the identity of each constituent of the group called the "Saginaw Intervenors" which e
