MEMORANDUM AND ORDER On October 31, 1978 the Chairman of the Licensing Board received the attached unserved mailgram dated October 29, 1978 from Mr. Wendell H. Marshall.

The Board treats Mr. Marshall's mailgram as a motion.

Considering the fact that the date for the special prehearing con-l ference would not permit time for service of the motion l

and answers by the parties, the Chairman arranged a telephone conference call.

In the process of arranging the call, Mrs. Hill, the Chairman's secretary, learned from Mr. Norton Hatlie that he wour.d not represent l

Mapleton Intervenors or Mr. Marshall in this proceeding.

The telephone conference was convened at 3:00 PM, October 31, 1978.

Participating were:

. of Michigan; Peter Flynn, Esq., for the intervenor Mary Sinclair ; Mr. Steve Gadler assisting Mr. Marshall and Mapleton Intervenors ; Mr. Wendell Marshall; Board Member Dr. Cowan, and the undersigned.

The Chairman read the mailgram, advised the parties of the reason for the call, and stated that Mr. Hetlie had reported that he would not represent Mapleton or Mr. Marshall.

The Chairman asked Mr. Marshall if there is any other satis-factory representative available to represent him and Mapl; con Intervenors.

He stated that Mr. Gadler would be a satisfactory representative.

Mr. Gadler assented.

Each participant stated that there was no objection to Mr. Gadler representing Mr. Marshall and Mapleton Intervenors for the limited purpose of the special prehearing conference.

The Chairman approved the arrangement and concluded the con-ference.

IT IS SO ORDERED.
