Dear Mr. Cherry:
This is in response to your letter of August 4,1976 requesting that I take immediate steps to terminate the construction permit for the Midland facility as a consequence of the recent Court of Appeals decision in Aeschliman v. Nuclear Re;:ulatory Commission.
Your letter indicates that Mr. Strauss informed you in a telephone conver-sation of my August 3,1976 letter to Anthony Roisman, Esq. For your information, I am enclosing herewith a ccpy of that letter. I indicated there the staff's view that the Court of Appeals " expects the Commission upon issuance of the mandate to exercise its discretion to determine, in i
light of all the circumstances and under applicable legal principles,
whether... [the Vermont Yankee] license should be continued, modified, or suspended during the further proceedings.
I am now authorized to inform you that without awaiting issuance of a mandate by the Court of Appeals, the Commission intends promptly to order the. reopening of the Midland proceeding for the purpose of considering whether the outstanding construction permit should be suspended, revoked, or modified. To that end, it will assign the matter in the first instance to a Licensing Board and willinstruct that Board to inform itself of the views of the parties. The same policy will apply I
to the Vermont Yankee proceeding.
