SUBJECT:
REQUEST FOR INSTITUTION OF PROCEEDINGS AND ASSESSMENT OF CIVIL PENALTIES AGAINST NORTHERN.'ilCHIGAN ELECTRIC COOPERATIVE, INC.; WOLVERINE ELECTRIC COOPERATIVE, INC. (COOPS); AND NATIONAL RURAL UTILITIES COOPERATIVES FINANCE CORPORATION (CFC) AND REQUEST FOR INJUNCTION TO PREVENT SALE OF PART OF MIDLAND UNITS 1 AND 2 TO COOPS, CFC AND THE CITY OF LANSING, MICHIGAN, POWER AND LIGHT By petition dated May 3,1978, Dr. Robert G. Asperger has requested, pursuant to 10 CFR 92.206, that the Comission institute proceedings to find the Coops and CFC in violation of the Atomic Energy Act and Comission regulations for illegally receiving ownership of the Fermi 2 facility and to assess civil penalties for such violation.
Dr. Asperger has also requested an injunction to prevent the sale of parts of Midland Units 1 and 2 to the Coops, CFC and the City of Lansing, Michigan, Power and Light.
This is closely related to an earlier request from Dr. Asperger.
Enclosed for your consideration is a draft response which draws upon your response to that earlier petition. Since the response to this petition will be made shortly, no Federal Register Notice is necessary.
