ORDER Before the Board is a " Petition to Reopen the Recoid and/or for Reconsideration of Initial Decision," filed by the Saginaw Intervenors (Saginav) on September 30, 1974, in which Saginaw requests us to reopen the record to consider the effects of the complaint filed by Consumers Power Company in the U.S. District Court for the Western District of Michig.in, Southern Division, against five defendants,' including Sechtel Corporation and Bechtel Company, the architect-engineers for the Consumers Power Company Midland Plant, Units 1 and 2.
S'aginaw contends that the lawsuit challenges the qualifications of Bechtel Corporation and Bechtel Company to provide quality control and quality assurance to Consumers Power Company at the Midland Plant, Units 1 and 2.
Accordingly, Saginaw contends that the filing of the lawsuit and the matters raised therein are relevant and material to the issues which we considered in this proceeding.
Also before us are oppositions of Consumers Power Com-pany, Bechtel Corporation and the AEC Regulatory Staff.

In view of the matters raised by Saginaw in its peti-
' tion, and the matters raised by the parties in ' opposition to the petition, we have decided to schedule oral argument on Sag-i;naw's motion.
The oral argument will be heard at 9:00 a.m.
