MEMORANCUM AND ORDER The purpose of this Memorandum and Order is for the Atomic Safety and Licensing Board (the Board) to rule upon the request by the NRC Staff for an extension of time from September 7,1976, until September 17, 1976, to file briefs. The Staff asserts as the basis for this request that the Atomic Safety and Licensing Appeal Board has before it a request by the intervenor New England Coalition on Nuclear Pollution (NECNP) to suspend the construction permits in Public Service Company of New Hampshire, et al. (Seabrook Station), Units 1 and 2), Docket Nos. 50-443 and 50-444, because further construction in Seabrook would cause prejudice to NECNP. The Staff suggests that the legal questions are similar and that a stay of filing briefs in this case would be appropriate since the Appeal Board decision in Seabrook may offer guidance to this Licensing Board in the instant proceeding.

The Staff advises that counsel for the Applicant has no objection to the extension of time, but counsel for the intervenors objects on the

,, grounds that the matter is an urgent one, that there is no assurance that the Appeal Board decision in Seabrook will be rendered by Septem-ber 17,1976, and that the Midland intervenors will not be able to participate in a decision (the Seabrook decision) that might establish legal principles which could control the Midland proceeding.

This Board has secured a copy of the August 24, 1976, Order by the Appeal Board in Seabrook calling for the responsive briefs and set-ting oral argument in that case for September 8,1976. The Board notes that the issue raised by the NECNP motion in Seabrook is whether the construction pemits for that facility should be suspended until the licensing board, on remand, can factor into the NEPA and safety analyses proper consideration of the incremental effects of reprocessing and/cr disposal of waste to be produced by the Seabrook plant.

However, in our proceeding, this Board is charged by the Commission's Memorandum and Order of August 16, 1976, with determining whether the construction permits for Midland should be continued, modified or suspended until an interim fuel cycle rule has been made effective. The guidelines on which we must base this decision are generally contained on page 9 of the Coninission's General Statement of Policy of August 16, 1976, cover-ing this matter.

In the Board's view, the issue before the Appeal Board and the issue to be covered by the briefs in this proceeding are sub-stantially different. In light of this, it does not appear that the

-s f Appeal Board resolution of the NECNP motion in Seabrook would be control-ling on the matter before this Licensing Board.

Accordinoly, since the NRC Staff has not set out any alternate grounds that would justify deferral of the briefing schedule, the Board hereby denies the Staff's request for an extension of time to file briefs.I/

Since the time for filing briefs continues to run, the Board advised the parties of its ruling herein by telephone this date.
