to the Board in the form of written testimony by Consumers Power Company, (Licensee) was inconsistent with material presentod by the Licensee in ~
its mor recent rate filings before the Michigan Public Service Commission.' t _
(Tr. 50u).
General allegations were made (Tr. 5043-44) regarding re-placement power, reliability, and coal costs by Mr. Cherry. The source of the allegations was identified by Mr. Cherry as Dr. Richard Tim, Intervenors' expert witness who testified in this proceeding in Chicago the week of May 9, 1977. The Board ordered the NRC Staff to report to the Board the substance of Dr. Tim's allegations and an analysis of them.
(Tr. 5053).
The Staff has undertaken a thorough review of both the testimony filed before this Board by the Licensee and the material presented by the Licensee to the Michigan Public Service Comission. The Staff has surmarized this review in its Attachment A to this letter, " Report Prepared by S. Feld and W. Gundersen for the Atomic Safety and Licensing Board on Alleged Discrepancies Between Consumers Power's Rate Filing of Jar try 31, 1977 and Testimony Presented to the Atomic Safety and Licensing Board in the Midland Proceeding."
In addition, the Staff has examined in the report the specific allegations made by Dr. Tim on the record of this proceeding the week of May 9,1977. The Staff concludes that there is no merit to any of the allegations raised by Mr. Cherry and that no discrepancies exist between the rate filing and the Consumers Power testimony in this proceeding which warrant further consideration by the Board.
