In the course of a telephone conversation latd yesterday afternoon, I was advised by Myron M. Cherry, Esq., counsel for the Saginaw Intervenors'in this proceeding, that he would today file

a motion for an extension of time to file exceptions to the ~

Decereber 14, 1972, Initial Decision of the Atomic Safety and Licensing Board in this proceeding authori::ing the grant of con-struction permits to applicant, Consumers Power Company.

Unless an extension is granted, the exceptions will be due to be filed on January 8, 1972.

See 10 CFR 2.762, 2.710, 8.3.

Mr. Cherry stated that the motion would be filed and served by mail.

Therefore it is likely that I will not receive the motion until Tuesday, January 2, 1973.

This is to advise the Board. that upon receipt of the motion I will promptly prepare an answer in oppositi on to the grant of any extension of time which will, among other r.tters, explain the substantial and harmful impact on the applicant and the public interest of any such extension.

I will, however, be agreeable to filing the answer with the Board within such reasonable period as the Board may prescribe shorter than that otherwise fixed by 10 CFR 2.730 (c).
