hll Y DOW RESPONSE TO ORDER CONCER'iING REMANDED ISSUES (January 4, 1979)

This memorandum is submitted by Intervenor The Dow Chemical Company (Dow), in response to the January 4, 1979 Order of the Atomic Safety and Licensing Board that the parties file certain information.

Although Dow is a party Intervencr in these proceedings, its special status has been recognized whenever the issue arose, by the. Board as well as the principal parties.

In this connection, attached is a copy of-this Board's Order,-' dated January 28, 1977, denying Dow's formal motion to withdraw.

That Order confirms what had been indicated on the numerous prior occasions, formal and informal, on which Dow has sought to avoid the adversarial legal implications of-con-tinued status as a party.

The Board has made it clear that it wishes to impose upon Dow the " obligation to bring forth information that it would not be obliged to produce as a mere bystander" or witness, because "without Dow, the record might be incomplete."

This obl.igation does not require that Dow file pleadings, take adversarial positions, or frame issues.

Dow assumes that the principal parties to this proceeding will specify the issues,
