Midland Suspension Proceeding Gentlemen:

As a result of the Board's ruling on Thursday, March 24, 1977, I have petitioned the United States District Court in Philadelphia for a short extension of time to enable me to present Dr. Timm's testimony on April 4 and thereafter participate in the remainder of these hearings.

I do not know whether the Court will grant my request.

However, I have assured the Court that this Hearing Board has ruled that no later than Sunday April.10,1977 the evidentiary record in these proceedings will terminate, based upon the Board's rulings that April 4, 5 and 6 will be set aside for cross-examina-tion of Dr. Timm and the remainder of the week, if necessary, for rebuttal.

I will advise the Board and the parties as soon as I can.
