Docket Nos. 50-329 and 50-330 Gentlemen:.

The purpose of this letter is to raise an important issue of propriety brought to light by the letter dated February of professional conducts 19, 1977 from Myron M. Cherry, Esq. to the Atomic Safety and Licensing Board.

On February 16,'.1977 at'Tr.'4575,- et _ seq, the Board inquired as to i

whether Mr. Cherry intended to proWde Dr. Tim as a witness and whether Mr. Cherry would continue in the case.

It was the understanding of the Staff that Mr. Cherry's subsequent telephone call to the Board would provide the Board with a simple yes or no answer in those questions.

Mr. Cherry's letter of February 19, 1977 relative to his conveeration with Dr. Luebke clearly indicates that he went far beyond the scope of

The Staff ur'ges the Board to admonish Mr. Cherry for these actions and to direct him to. refrain from repeating such acts in the future.
