On March 2, 1977 I served a copy of the Licensee's additional testimony as well as a motion in support of filing such testimony on the Board, and the parties to this proceeding.
Pursuant to Mr. Cherry's request, I also sent a l
copy of the testimony air mail - special delivery to Dr. Richard A. Timm.
However, I inadvertently included copies of the Licensee's rebuttal testimony to Dr. Timm's presentation, in violation of the Board's order.
To correct that mistake, in Mr. Cherry's absence, I have attempted today to contact Dr. Timm.
He is presently out of his office and will not return until tomorrow.
However, I did inform Dr.'Timm's office of my error and requested that he return the material which I sent to him yesterday unopened.
t I am transmitting to Dr. Timm today, by Air Express, a copy of Licensee's motion and testimony which is not in rebuttal to Dr. Timm's presentation.
