g Arthur W. Murphy, Esq., Chairman Atomic Safety and Licensing Board THIS DOCUMENT CONTAINS Columbia University School of Law P00R QUAUTY PAGES 435 West 116th Street New York, N.Y.

10027 In the Matter of Consumers Power Company Midland Plant, Units 1 and 2 Docket Nos. 50-329 and 50-330

Dear Chairman Murphy:

I have just learned that on February 4, the Mapleton Intervenors mailed their submissions pursuant to 'l 5 B (2 ) of the Hearing Board's December 22, 1971 Order.

Again, we have not received copics.

Enclosed is a copy of our September 24, 1971 letter to the Board making a similar protest for the thir's time, and request-ing that the Board direct the Mapleton Intervenors to comply with the requirements of law, and specifically to furnish with each submission a certification in the form similar to that used by us.

The timetable fixed by the Board is a tight one, as we believe it should be.

In this case, Opposing Intervenors' submissions were due February 4 and ours Feb.ruary 14.

If the Board is to continue to consider defective Mapleton papers, practices such as this will inevitably lead to a breakdown of the Board's schedule.

We repeat our request that the Board take action to compel the proper service of copies by the Mapleton Intervenors.

Respectfully, i

e). y '
