Dear Dr. Lindsay:

This is in further reference to the Midland project in which Constaaers Power Company proposes to deliver stema produced by the nuclear reactor to the Dow ch-teal company for manufac-turing processes.

In the early design of the system which was discussed in my letter to you on June 10, 1970, the stems was to be taken fram the secondary side of the main stema generators and delivered directly to the Dow mmunfecturing complex.

Consumers Power Company now proposes in amendnenta 15 through 18 to its application (enclosed)-to pass the secondary secan i

~ through an additional set of heat exchangers to produce steam in a tertiary system.

This tertiary steam will be delivered to Dow where it will be used for mechanical and charmal energy and for===dacturing chemical products.

, Consumers proposes to install appropriate monitoring and analytical facilities to detenmine whether radioactivity is being added to the tertiary staan by leakage through the two preceding heat exchangers.

If detectable leakage occurs, corrective action will be taken at the reactor plant, or delivery of stema to Dow will be terminated.

The detci?.ed procedures for monitoring and control of the tertiary s'pcan will be developed during the construction phase of the reactor operation.

Dr. Dale R. Lindsay Constuners states that the tertiary staan will contain essentially no more radioactivity than the treated (demineralized and/or filtered) make-up water from Lake Huron.

Under these conditions Dow would not be required to obtain an AEC license in order to receive, possess or use the steam delivered by Consumers.

Appropriate pro-visions wLil be incorporated in the AEC license to Consumers for operation of the nuclear power plant to assure that these conditions are maintained.

_y would be in violation of the license con-dicions and thus, subject to appropriate enforcement action.

Similarly, Dow Chemical would be in violation of Commission regulations which prohibit the use of reactor-produced radioactive material in products in-tended for human consumption and would also be subject to appropriate enforcament action.

The AEC regulatory staff and the Advisory Committee on Reactor Safeguards (ACRS) have now completed their review of Consumers' reactor construction permit application.

Enclosed for your information is an ACRS supplemental Report on the subject.

We would be pleased to have your comments regcrding the compatibility of this project as it now stands with such functions as the FDA performs with respect to the project.
