TMIA'S MOTION TO -

WITHDRAW CONTENTION 7 TMIA, by its attorneys, Widoff, Reager, Selkowitz, and Adler, P.C., requests the Board to issue an Crder permitting the withdrawal of TMIA Contention 7. TMIA is forced to request this order because TMIA does not possess the financial resources necessary to develop admissible evidence on this contention that would be useful to the Board in making its recommendations on the restart of TMI-1. TMIA's own lack of financial resources, combined with its inability to obtain Intervenor Funding, make this painful step necessary.

This motion should not be interpreted to mean that the iss~ues addressed in Contention 7 have been sufficiently addressed by Licensee. To the contrary, serious problems still exist that demand attention by both the staff and the Board. Particularly, TMIA requests that the Board require Licensee's response to TMIA's interrogatories based on the 10,000 gallon leak numbers 3 and 4 be submitted to the staff and Board for consideration.
