NRC STAFF RESPONSE TO TMIA'S MOTION TO WITHDRAW CONTENTION 7 On July 31, 1980, counsel for TMIA served on the parties a " Motion to Withdraw Contention 7."

This Motion asks the Licensing Board to grant TMIA permission to withdraw Contention 7 and suggests that the Board adopt that contention as a board question.

The Staff does not, and is not in a position to, object to the withdrawal of the contention. The issues contained in Contention 7, however, are essentially the same as those contained in CEA Contentions 5, 6, and 7 and in Aamodt Contention 8.

Therefore, the " serious problems" alluded to by THIA will be addressed by the Staff and the licensee at the hearing and there is no need for the Board to adopt Contention 7.
