Gentlemen:

Geor* Power Company hereby responds to the NRC's Notice of Violation dated June 19, 1980, concerning an excessive radiation exposure rate inside the cab of the vehicle transporting wastes from Plant Hatch to a licensed dispcsal site. An investigation was conducted into the incident and survey practi.es at Plant Hatch. Based on our findings, we disclaim the alleged severit/ of noncompliance for the reasons stated herein.

A radiation survey of the vehicle made prior to departure from Plant Hatch demonstrated the shipment to be in compliance with applicable laws and regulations. Our documentation of the survey indicates the highest radiation level measured in normally occupied positions was 1.5 mrem /hr.

By all indications available to us, the shipment was within the 49 CFR 173.393 (j)(4) limit of 2 mrem /hr.

Georgia Power Company remains committed to maintaining the highest standards of Health Physics practice and compliance with laws and regula-tions. After notification of the violation, the Plant Hatch staff imituted a conservative administrative limit on dose rate for fu'.ure shipments from the plant. Very low range ionization chamber detectors will be used for taking dose rate measurements on future shipments. We trust that these measures will avoid a repetition of similar conditions.

Because there is no evidence of intentional or negligent wrongdoing in regard to the alleged violation, we request that the severity of the viola-tion be mitigated and the civil penalty removed.

We deeply regret any appearance of impropriety this incident may have caused.
