Jt) L 1 0 T 0 MEMORANDUM FOR:

John 0. Schiffgens, Materials Engineer, MEB, DE FROM:

Richard H. Vollmer, Director, DE

SUBJECT:

EXEMPTION T010 CFR 0.735-21 I have reviewed your Confidential Statement of Employment and Financial Interests (Form NRC-269) and note that you report, as a former employee of Westinghouse Electric Corporation, a vested interest in their pension plan.

In order to allow you to work on licensing matters involving the Westinghouse Electric Corporation an exemption from the provisions of 10 CFR 0.735-21 must be granted.

A review of the terms of the Westinghouse Electric Corporation pension fund by the Office of the General Counses has revealed that as an NRC employee you cannot influence, in any fashion, the amount you receive as a pension from Westinghouse Electric Corporation.

Based upon this finding, I have dotermined that your interest in the Westinghouse Electric Corporation pension tund is not so substantial as to be deemed likely to affect the integrity of your services to NRC and that no provision of law and no NRC regulation would appear to be violated by your participation in matters affecting the Westinghouse Electric Corpora tion.

Therefore, with the concurrence of the Office of the General Counsel, you are hereby granted an exemption from the requirements of 10 CFR 0.735-21 and you may participate in matters before the NRC affecting the Westinghouse Electric Corporatfon.
