ORDER RULING ON MAPLE' ION INTERVENORS JUNE 30, 198,0- PETITION 'IO THE BOARD (July 24, 1980)
Mapleton Intervenors, by its President Wendell H.
Marshall, moves the board:
1) not to consider Consumer's motion for consolidation because it was not previously given proper notice of the motion and because Mapleton would have opposed Consumer's request for a hearing in this proceeding had it been informed of the request; and 2) to suspend the Midland construction permits.
Mapleton's complaint about not having notice of the motion for consolidation, even if true, is moot because the board has

deferred responses to the motion until after intervention has been determined.
Memorandum and Order June 27, 1980.
As an intervenor in the Midland operating license proceeding, Mr. Marshall as an individual will have an opportunity to respond to the consolidation motion.
If he is accepted as an intervenor in this proceeding te will also have an oppor-b II tunity to respond in that capacity.

e Mapleton's complaint about not being informed of Consumer's request for a hearing in this proceeding does not demonstrate any standing to protest the requested hearing.
The Commission's Notice of Hearing in this proceeding, published in the Federal Register on March 20, 1980 did not delegate jurisdiction to this board to suspend the Midland construction permits.
Mapleton's petition of June 30, 1980 is denied.
