The allegations, which were general in nature and which were provided to you by persons wishing to remain anonymous, relate to improper testing or failure to perform required tests in the areas of (1) cooling pond earth dike sections, (2) concrete aggregate, (3) steel reinforcement, and (4) concrete slump.

During several subsequent telephone conversations, we emphasized the need to obtain more definitive information ta allow our inspectors to adequately investigate the allegaticas. As part of these conversations, I offered, through you, full assurance to those making the allegations that their identity would be protected and would not be revealed by the Atomic Energy Commission. As discussed, 10 CFR 19.16 provides l

protection to individuals alleging violations of the regulations to i

the Atomic Energy hiesion from being discriminated against or I

discharged. Furthermoie, I personally agreed to meet with the individuals alleging the deficiencies in an attempt to allay their concerns. The last such assurance was given during our telephone conversation of January 3, 1975.

As stated earlier, without furthar, more specific information, it is not possible for our inspectors to conduct a meaningful investigation of these matters - pursuing the allegations provided is like trying ta find "the needle in a haystack." I would like to emphasise, however, that our normal inspection program does provide for a continuing sampling review of records and physical inspection of phases o,* construction activitiae involving safety related structures, systems, equipment, and components, including specifically the integrity of the cooling pond and the quality of the concrete and reinforcement steel.

i Mr. David Stoll January 16, 1975 Deficiencies, relatable to concrete placement and preparation of the cooling pond, have been identified by the Consumers Power Company and the Bechtel Corporation quality assurance / quality control personnel and documented in Audit Reports, Quality Assurance Discrepancy Reports, or Nonconformance Reports. Copies of these reports, written or resolved during each month, are provided to the Atomic Energy Commission in compliance with a decision handed down by the Atomic Safety and Licensing Appeals Board (Condition 4 of " Memorandum and Order ALAB-106"). The Region III Office of Regulatory Operations has, and will continue to, routinely review these reports for proper identification and resolution of deficiencies and for generic quality assurance / quality control provam implementation considerations.

In that better than six weeks have elapsed since the time of your initial telephone contact and the individuals making the allegations remain unwilling to discuss the alleged deficiencies with the Atomic Energy Commission, we are dropping this matter as an unresolved issue.

Should those making the allegations change their minds and agree to provide us with specific information in the future, we will naturally pursue these matters further.
