(ALAB-91) j On January 9, 1973 the applicant filed a " Motion.
Relating to Procedures Affecting Saginaw Intervenor's Claim j
of Bias".
That motion asked that we assume jurisdiction 4'
over, and fix the time for responding to, a motion which the intervenors, Saginaw Valley et al, had filed on January 7, I
i 1973 with the Licensing Board in this case.
The Saginaw Intervenors' motion asserts that one of the members of the Licensing Board which had rendered the j
December 14, 1972 initial decision in this case was biase'd and that the initial decision should be recalled for that reason.
Applicant here notes that the intervenors' motion, 1

venors' motion is beyond the jurisdiction of the Licensing Board and that, "as a matter of efficient adminideration" the motion should be dealt with by us.
For us to grant the applicant's motion in the circum-

stances of this case would be singularly inappropriate.

The intervenors' motion was addressed to the Licensing 1
Board and that Board should have full opportunity to, rule on its jurisdiction to entertain it,

other questions it deems to be before it.
There is no occasion for our involvement prior to either a Licensing

Board ruling on intervenors' motion or a submission by i
the intervenors to this Board.
Accordingly, the applicant's motion is denied.
