APPLICANT'S ANSWER TO MAPLETON INTERVENORS ' NOTICE OF APPEAL FROM THE ORDER OF THE ATOMIC SAFETY AND LICENSING APPEAL BOARD DATED JULY 19, 1972 On August 9, 1972, there was filed a " Notice of Appeal of Mapleton Intervenors from the Order of the Atomic Safety and Licensing Appeal Board Dated July 19, 1972".
Thereafter, on August 18, 1972, the AEC Regulatory Staff filed an answer in opposition to the notice of appeal, emphasizing that there is no procedure for such an appeal, and that the notice of appeal "is in direct contravention of the Commission rule concerning review of decisions and actions of the Atomic Safety and Licensing Appeal Board.
The answer also pointed out that the order of the latter body is, in any cvont, " correct in resuit and should be af firmed. "
The Applicant believes that both of these views are so patently correct that Mapleton's notice of appeal is without merit.and should be denied.
