Dear Mr. Murphy:

As alleged by Mr. Cherry, he has been meeting with the representatives of Consumers Power with respect to the Palisades Nuclear Plant at the times and places specified in his affidavit.

Undoubtedly, he does have an extremely busy schedule.

However, we feel compelled to point out that Mr. Cherry accepted employment on this case knowing full well that he was actively engaged on the Palisades case and the other cases to which he refers in his affidavit.

'Mr. Cherry is a member of a large, eminent and prestigious firm in Chicago which has relatively unlimited resources in terms of i

man power.

Mr. Cherry should either draw upon the resources of his firm or not attempt to undertake more work than he can accomplish.

We are' sympathetic with the fact that he is carrying an extremely teavy work load and perhaps some consideration should be given in this instance to his request.

However, his inability to cope with 1

all of his work will inevitably be a centinuing thing and will undoubtedly lead to further requests for delay in the future.

Under the circumstances,.there is no way of knowing whether his i

request for a March 22, 1971, date is reasonable or unreasonable 1

but it appears to provide for an excessive amount of time.
