A MODIFICATION TO THE FEDERAL REGISTER NOTICE AND FINAL RULE CHANGES ON EMERGENCY PREPAREDNESS SUBMITTED FOR COMMISSION APPROVAL IN SECY-10-275
Purpose:
To respond to the 'Comission's directives for changes in the final rule on emergency preparedness.
Discussion:
SECY-80-275 contains proposed changes to 10 CFR Part 50, Section 50.33, Section 50.47 and Section 50.54, as well as clarification and expansion changes to 10 CFR Part 50, Appendix E.
During the Comission meeting held on June 18, 1980, the Comission identified some areas in the Federal Recister Notice that needed clarification.
This paper provides the staff!s proposed changes to respond to each of the Comission's directives.
1)
That the staff clarify the meaning of the term " objective" as it is used in section 50.47 of the rule changes.
The staff proposes to substitute the word " standards" for the word " objectives" throughout the Federal Register Notice, including the rule changes, except for the use of the term " design objective" in connection with the 15 minute notification capability. Enclosure A-1 is a replacement page 31 of the rule changes showing a sample of this substitution.

That the staff attempt to incorporate into the Supplemental Information language indicating that the State and local officials should exercise their judgment in assessing the use of the 15 minute 4
notification capability.
The staff proposes to incorporate additional words on page 25 of the Supplemental Information accompanying the rule. A replacement page showing these additional words is provided as Enclosure A-2.
- 3) That the staff attempt to clarify the frequency of exercises requirement.for states that have no reactors located within them but are within the EPZ of a reactor located in another state.
The staff proposes to provide this clarification by changing the wording on pages 50 and 51 of the draft rule changes. The staff is taking this opportunity to also propose other clarifying changes concerning the exercise requirements in order to resolve comments provided by some states. Replacement pages 50, 51 and Sla showing the proposed wording changes are provided as Enclosure A-3.
- 4) That staff should explain different approaches to disseminating emergency preparedness information to transient and non-transient populations around a given reactor.
The staff proposes to provide this explanation by adding additional words to page 47 of the rule changes. A replacement page showing the proposed additional words is provided as Enclosure A-4.
Cast Estimates:
This addition does not change the cost estimates projected in SECY-80-275.
