Lawrence P. Crocker, first being duly sworn, deposes and says:

I am the Technical Assistant to the Director of the Division of Project Management in the Nuclear Regulatory Comission. My professional qualifications appear following Tr. 4177 of the transcript in this proceeding.

In this affidavit, I present the daa available to the Staff regarding the construction costs and schedules for the Midland Plant.

The Nuclear Regulatory Cca=ission (NRC) does not normally collect or maintain cetailed cost and construction progress data regarding specific nuclear power facilities.

Such data as we do have avail-

. able are as reported by the licensees for the facilities. We have no responsibility for, nor do we become invo'ved with, either the scheduling of construction activity or the rate of expenditure of project funds.

2-The NRC regional-offices do maintain an awareness of near tenn construction activities as projected by the licensees in order to schedule inspections of the construction work in progress.

Further, on a monthly basis, the NRC publishes a Construction Status Report, NUREG-0030, which provides data as. reported by the licensees on the pmjected construction activity at each nuclear facility. The purpose of this periodic report is'to enable the staff to maintain an awareness of projected fuel loading dates so that it can properly schedule staff review efforts.

The NRC Office of Management Information and Program Control (MIPC) is respor.sible for publication of NUREG-0030.

Based on MIPC records, they have furnished data on the quarterly construction progress for the Midland Plant,. Units 1 and 2, as shown on Table 1.

Data for construction completion for the periods through September 30, 1977, are as reported to MIPC by Consumers Power Company.

The estimated percentaga completion figures from December 31, 1977 through December. 31,1978, are NRC staff estimates of the probable construction progress that will be T.ade during the current calendar quarter and continuing through 1978.

These estimates are based on the assumption that the construction effort will continue at about the present rate during this period. The latest report from the licensee. estimates the construction comple-tion as of the end of October 1977, to be 31% for Unit 1 and 35%

Over the last ten months, construction placement has averaged about 1.5% per month.

Constructiora of the Midland Plant actually started in &ccordance with a variance issued on July 30, 1970, which allowed limited

' preconstruction activity.

Construction permits for the Midland units were not issued until December 15, 1972.

Construction was suspended during the Spring of 1973 while hearings were held regarding quality assurance for the design and construction. On May 23,1973, the construction permits were amended to incorporate quality assurance reporting requirements. Actual plant construc-tion resumed on June 15, 1973.

The funds expended on the Midland Plant, as compiled from data available to the.'fRC staff are shown on Table 2.

These data were obtained from annual reports of Consumers Power Ccmpany for the periods through 1976 and from the licensee's response ta Intervenors Interrogatory No. 3 for calendar years 1977 and 1978.1/ The NRC 1/
