Dear Chairman Murphy:

We. protest the continued pouring of miscellaneous materials into the hopper by the Mapleton Intervenors, in violation of every procedural and substantive rule in the book.

Mapicton's January 5, 1972 letter, enclosing Professor Whitelaw's letter and attachments, violates even Mapleton's own December 13, 1971 application, in which they " respectfully request until December 31, 1971 to serve the testimony of...

Professor R. L.-Whitelau" (underlining added).

One gets the impression that the Mapleton Intervenors i I

don't really care whether the Board or the parties read this

  • material, but are simply stacking the record with a mass of affidavits, letters, books, magazine articles and the like, which they can use if, as and when the matter is ever reviewed by another body.

It is an old trial lawyer's tactic to load a hearing record with the kitchen sink by way of offer.of proof or otheruise, from which an appellate record can be created which 8006800 ~10 0 6- q s

An alternative!is'for those favoring the application to similarly load the record with offers of proof--incorporating the far more voluminous naterials which contradict those

- submitted by Mapleton. ,

But the preferabic course would be for the Board to p put a stop to this'once and .for all, by sanctions under Title 10,,C.F.R. --SS 2.713(c) and 2.718(c) and (1).
