On October 30, 1970, an article in the Midland Daily News.

announced that a construction license hearing for the proposed Midland nuclear power plant will be held in Midland beginning on December 1. It also announced that Novemba- 12 will be the deadline for receiving petitions for leave to intervene.

I had previously understood that there had to be a minimum of 30 days between such an announcenent and the date of the pre-hearing conference (scheduled for November 17th) and a minimum of 40 days between the announcement and the hearing date. I would appreciate an explanation of why this has not been true in the case of the proposed Midland plant.

It is also my understanding that the Final Safety Analysis Report (FSAR) is available concurrent with announcement of the licensing hearing in the Federal Register. I would appreciate receiving one copy of the FSAR immediately.

The newspaper also referred to two documents which would be available from you: a safety evaluation of the proposed plant by the AEC regulatory staff and a statement of em enmentaA considerations relating to issuance of construction permits.

It is important that I receive copies of these documents immediately.

Thank you for your assistance. Anything you can do to expedite your response and the documents would be very much appreciated.
