In the Matter of )

) NRC Docket Nos. 50-329A CONSUMERS POWER COMPANY ) 50-330A (Midland Plant, Units 1 and 2) )

MOTION OF THE DEPARTMENT OF JUSTICE FOR SCHEDULE MODIFICATION Pursuant to Rule 2.711 of the Nuclear Regulatory Commis-sion's Rules of Practice, the U. S. Department of Justice hereby moves for the following changes in the schedule for the submission of briefs'in support of exceptions to the Initial Decision of the Hearing Board:

Briefs in Support of Exceptions - Notember 13, 1975 Answering Briefs - January 19, 1976 Reply Briefs - February 9, 1976 The current schedule was fixed before the parties could fully analyze the 180-page Initial Decision of the Hearing Board and thereby accurately project the amount of time re-quried for briefing of the appeal. With a trial record of over 600 exhibits and 9,000 pages of testimony, it has simply not been possible to deal with the complex issues presented in this case within the allocated time period.
