ANSWER OF AEC REGLATORY STAFF TO NDTION ICR OREER hDDIFYING PFOCEDURAL SGEEULE OF CONSID2RS POWER CC:@AW Pursucnt to 10 CFR, Part 2, Section 2.730(c) of the Ccamission's Pules of Practice, the AEC Regulatory Staff (staff) hereby caswars tha metien of Consumers Power Company (applicant) to mcdify the procedural schedule for completion of documentary production.
Applicant's motion indicates that it has substantially completed res-ponses to each of the asteristed items as well as several other items.
The bulk of the remaining items relate to infomation requ;sted by the D3partment of Justice and believed necessary for the develcp= cat of a
~
record for a finding pursuant to the requirement of Section 105C(5).
According to the applicant, the compiling of this infc=ation will take 4
much longer than cnticipated and therefore it is requested that the Second Prehearing Conference Order of the Atomic Safety and Licensing Board, dated November 3,1972, be modified to provide for the completion of documentary production by May 1,1973. This would, of cours2, require date c'unges with respect to the remaindar of the time schedule.
i The applicant states that time for the production of dccum:.nts could i
l be reduced if the file search were limited to the central files which would obviate the search for documents from nt=crous field offices.
THIS DOCUMENT CONTAINS 8006190fff
/#7 P00R QUAllTY PAGES
. Since the Department has requested that all files be searched, in-cluding field offices, the staff will leave.to the Department the determination as to whether it is now believed that such a search may no longer be necessary.
The staff is cost concemed that this case move alcng as expeditiously as possible and to the extent possibic would hope that the dotes now contemplated by the applicant could be materially shortened; hot. ver, the staff, with the caveat expressed above as to the necessity to search field offices, does not object to the motion for : difying procedural schedule.
Respectfully sub.nitted,
