Dear Mr. Kruesi:

This letter, submitted pursuant to 10 CFR 850.55(e)(3), vill confirm our Mr. Willica E. Kessler's January 16, 1973 telephone report to Mr. Walt Vetter of your Region III office concerning an item of vendor code noncompliance which could be considered reportable under revised 10 CFR 550.55(e)(1)(1).

The item of nonco=pliance in question, first noted in a Consumers Power Company QA audit conducted in Babcock & Wilcox's Barberton facility, consisted of incomplete documentation of the strength and fracture toughness of material used in making repair velds on three of the Midland Plant steam generators. While the documentation vould have satisfied the 1965 vercion of AS:IE Code Section III, it did not satisfy the 1968 revision of the Code.

After naking an investigation, ELW prepared a report on the matter, which it delivered to Fir. R. H. Engelken of your staff during a meeting on this subject in Bethesda, Maryland on January 30, 1973.

That report is incorporated herein by reference.
