MOTION OF CONSUMERS POWER COMPANY TO FILE RESPONSIVE FINDINGS AND BRIEF INSTANTER Consumers Power Company (" Licensee") moves this Atomic Safety and Licensing Board (the " Board") to accept the filing of Licensee's Responsive Findings and Brief instanter. As Licensee explained in its July 8, 1977 letter to the Board, Licensee did not receive the Findings of All Intervenor.s Other Than The Dow Chemical Company until 6:30 p.m. on Friday July 1, 1977 and the NRC Staff's Findings did not arrive until July 7, 1977. Licensee worked diligently toward the goal of filing its Responsive Findings and Brief 1

on July 12, 1977; however, because of the amount of material to be dealt with, and the extent to which Licensee was ccm-pelled to comment on Intervenors' Findings, in order to i 1

correct what it believes inaccuracies and errors contained therein, Licensee did not complete its responsive pleadings until July 14, 1977. The documents were not completed sufficiently early in the day on the 14th to permit their l 00 61gg }

delivery to the Board in Washington. Consequently, they are being delivered e'arly on the morning of July 15, 1977.

These items are also being hand-delivered to the NRC Staff and Intervenors early on the morning of the 15th and mailed to The Dow Chemical Company on the 14th.

For the reasons set forth above, Licensee moves the Board to accept instanter the filing of Licensee's Responsive Findings and Brief.
