Gentlemen:
In remanding the Midland construction permit proceedings to the NRC, the Court of Appeals directed the NRC to consider any changed circumstances regarding The Dow Chemical Company's need for process steam from the Midland Nuclear Plant and the intended continued operation of Dow's fossil-fuel generating facilities.
Aeschliman v NRC, 547 F 2d 622, 632 (DC Cir 1976).
The Court of Appeals decision was reversed in Vermont Yankee Nuclear Power Corp v Natural Resources Defense Council, 98 S Ct 1197 (1978).
Thereafter, the Commission requested the parties in this proceeding to state their views as to what issues, if any, remain for further NRC consideration in light of the Supreme Court's decision, and the parties have done so.
That matter is before the Commission for decision.
Ac-cordingly, the Commission should be aware thac Consumers Power Company and The Dow Chemical Company have executed renegotiated contracts respecting the Midland facility, covering the surply of process steam and electricity to Dow.
The re-negotiated contracts are in the form of a General Agreement and an Agreement for Electric Service, both dated June 21, 1978.
Copies of these agreements are en-closed for your !nformation.
The enclosed copies of the General Agreement do not include Section.4.C of that Agreement, which specifies the rates and charges for process steam to be supplied to Dow.
Dow regards the provisions of that Section as confidential commercial in-formation.
Section 4.C will be filed with the Commission separately with a request that it be exempted from public disclosure.
