In the Matter of the Toledo Edison Company and The Cleveland Electric filuminating Company _(Davis-Besse - Docket No. 50-346 and Case No. 71-1396 - Coalition for Safe Nuclear Power, et al. v. AEC, et al.
Gentlemen:
On October 21, 1971, the above captioned matter was remanded from the United States Court of Appeals for the District of Columbia to the Commission for NEPA review,
" including the consideration of suspension of the construction permit" issued to Toledo Edison and CEI for the Davis-Besse plant.
That review is now in progress under Appendix D of 10 CFR, Part 50, 5E.
As counsel for intervenors Coalition and LIFE, I am advising the Commission that we wish to present opposing comments'upon the statement submitted to the Commission by the applicants as to why construction should not be halted during NEPA review.
Our comments'will be submittcd within thirty days of the date of this letter and we request that no decision'be made until our comments can be received and evaluated by the Commission.
This request has been delayed because the applicants did not deliver a copy of their statement to me at the time they filed same with the Coninission.
