Citicons for Clean Air C.1:ator, Inc., strannously objects to the iscuance of a permit by the Corps cf rnsinocra to Ioledo Edison Co pany for a bargo channel as a part of the Davic-13csco Guclear Poucr Plant Station, in Lako Erio, at Ottawa County, Chio. Cur rossono for objecting cro as follows:

1. % construction licenso which Tclado Fdison Cc=pany rccsivod from the Atomic Energy Oc:rission is obviously 111ogol..Thu Atomic Enorgy Co=nission and Toledo Edison have not conolied with the rcquironents of tho ::ational Environnental Pol-icy t.ct, of Janucry,1970, and thoro uill havo to be a no.i hearing. (Calvert Cliffs locicion, Jodcral District Ceutt, Washington).
2. The Coalition for Safe Unclocr Pouer, of which Citizens for Clonn Air & Water in a conber, has filcd a ccco in District Court in '.:ashington, asking for an injunction to halt construction, and for a now hearing.
3. AlthouCh Tolodo Edison cubr.ittcd an environ =cntal report into the record of the AEC hearing, we, as intarvorcrs, in the hearin3 were not allowed to question thil repert, nor Woro wo allowed to question the authors of the repert. The report is incocolete, inadequato in secna, cnd hcs been edited by the power coc-

The *.later Quality I:::>rovement Act of 1970 rcquired staten to cortify that dicchargos frcn fedcrclly licenced cperatione, such as nuclear power plants, will ncct ths water qcality standards of the st te. Tnc htate of Chio has not certi-fiod that tha dicchar ;oc frc= tic plant will neot the unter quality standards of Ohio. It is the contention of the Walition and CCM;, that they will not acot the standards for the follosing reasons
c. They violate the non-degradation clauco of cur liator Quality Standards

, by not incorporating highest degrou of treatment.

b. They violate the minimum conditions apnlicable to all waters, at all tires, at cM. places, that nothin;: harnful or toxic to hu lan, enigal, plant, or aquatic life shall be in the wotor.
c. AM tests on the Emer6cncy Coro Cooling Systen for the plant havn shown

Linco cny accident will violcte the water quality standards of Chio, it is obvious that thero is no assurance that the plant will not violate cuch standards.
