Deat-Mr. Train:
Con::ernea citizens and students in the.Bouling Green and Cleveland area have tormed the Coalition for Safe Nuclear Power in order to represent the public interest in the Davis-Besso Nuclear Power Plant Licensing Hearings.
Our concern is in the conservation, recreational, economic, aesthethic and j
commtnity impact of the nuclear power p.Lant on the shores of Lake Erie.
The group represents 13 labor, environ:r. ental, and consumer organizations and 10 individuals, some 60,0VO persons.
Under AEC interventien policy, ' supposedly the AEC invites public scrutiny and welcomes comment of independent experts and tne general puo 1c.
Our original counsel, Mr. C. R. Marvin, Cleveland, was to repreennt us in this ca~, but very recently his firm indicated that eney wre not interested in continuing with the case. His decislo.. came just days before the
' Pre-Hearing on the construction permit on Novenber 23.
Lacking prepared counsel at the Pre-Hearing, we were obviously crippled.
We were not granted intervencre status and an appeal for a delay (fer time to secure an attorney and to prepare the cace) of the Hearings scheculed for December 8 was refused. We feel we are justified to ask for time to prepare, since ve vere given only 20 days notice of the Pre-Hearing and were given the recently prepared AEC Environmental Report at the Pre-Hearirg November 23.
It would have'bcen ir:possible for us to have been able to exanine the Report ifor any answers to our environmental impact questions in our intervention pe tition.
To refuse us as they did seems not to be keeping *with stated AEC ~

policy,. and in fact, constitutes a denial of due prececs of law.
Also, because of cur inability to produce the large suns of mency needed for intervention carticipation, we doubt whether the public interect can be represented at all at such hearings. To make such hearings of public concern open to the public and then, to make it impossibly difficult fo_r them to become a part of the proceeding;s-scens to be a mockery of the denocratic way and in. conflict with present law.
