REPLY OF THE TOLEDO EDISON COMPANY AND THE CLEVELAND ELECTRIC ILLUMINATING COMPANY TO REQUESTS OF STEVE GANNIS

1. On January 30, 1973, the Atomic Energy Commission ,

(" Commission") received a letter from Steve Gannis requesting

" official and absolute permission to intervene according to the law to make a statement" and requesting " permission to be-come a formal legal party" in the captioned proceeding.

2. As a petition for leave to intervene, the request meets none of the requirements of S2.714 of the Commission's Rules of Practice. The request fails to set forth contentions and fails to set forth the interest of Mr. Gannis in the pro-ceeding, how that interest may be affected by the result of the proceeding, and the facts and reasons why he should be permitted to intervene as required by 10 C.F.R. S2.714(b). In addition, Mr. Gannis has failed to supply the required supporting affidavit identifying the specific aspect or aspects of the subject matter soos ou ffy C

as to which intervention is sought and setting forth with particularity both.the facts pertaining to his interest and the basis for any contentions. Leave to intervene should therefore be denied.

3. The Toledo Edison Company and the Cleveland

Electric Illuminating Company would have no objection to Mr. Gannis' participation in the proceeding by means of limited appearance.
